President John Dramani Mahama has assented to the Community Service Act 2026, a non-custodial reform package, alongside nine other major legislative bills into law. This historic signing introduces sweeping judicial, fiscal, and economic reforms designed to reduce prison overcrowding, plug revenue leakages, modernise law enforcement, and provide substantial tax relief to low-income Ghanaian workers.
Speaking alongside Chief of Staff Dr Julius Debrah and state ministers following the signing, President Mahama emphasised that this progressive legislative package fulfils key government pledges while establishing a streamlined legal foundation for sustainable national development.
Community Service Act 2026: Mahama Reforms and Prison Cost Reduction
A central highlight of the legislative signing is the Community Service Act 2026 Mahama initiative, which officially introduces non-custodial sentencing options for minor offences across Ghana’s judicial system. President Mahama explained that transitioning away from mandatory imprisonment for minor infractions will significantly alleviate prison congestion while saving taxpayers millions in custodial upkeep.
“Instead of putting people in jail and the government having to pay for looking after prisoners for stealing goods or for committing some very minor offences, they can be sentenced to do community service for the periods that they are convicted for,” President Mahama declared during the ceremony.
Under the new legal framework, individuals convicted of low-level, non-violent offences will be required to perform public maintenance, environmental restoration, or community support work rather than serving short prison sentences.
Tax Reliefs, Agricultural Transformation, and Industrial Development
Beyond judicial modernisation, the ten newly enacted laws cut across critical sectors of the national economy, business development, maritime security, education, and social protection:
- Income Tax Relief for Low-Wage Earners: The Income Tax (Amendment) Act, 2026 officially exempts individuals earning the national minimum wage or below from paying income tax, providing direct relief to low-income households.
- Support for Cocoa Farmers & Local Processing: The Ghana Cocoa Board Act, 2026 legally binds the government to its agricultural transformation promises. It mandates that at least 50 per cent of domestically harvested cocoa beans be processed within Ghana, while guaranteeing that local cocoa farmers receive at least 70 per cent of the prevailing world market price for their produce.
- Local Manufacturing Incentives: The Excise Act, 2026 consolidates excise duties, blocks revenue leakages on imported goods such as alcohol and cigarettes, and grants targeted tax exemptions to domestic fruit juice processors to stimulate local agro-industrial growth.
Fiscal Discipline, Energy Levies, and Strategic Reserves
To improve administrative efficiency and seal systemic revenue loopholes, President Mahama assented to key financial and commercial statutes:
- Customs Code Consolidation: The Customs Act, 2026 unifies all existing customs laws into a single, comprehensive statute, making it simpler to administer while closing long-standing revenue leakage loopholes.
- Energy Levy Exemption Tightening: The Energy Sector Levies (Amendment) Act, 2026 eliminates widespread tax abuses by requiring industrial factories and maritime vessel operators to pay fuel oil taxes upfront and present verifiable proof to claim reimbursements.
- VAT Exemptions for Gold Reserves: The Value Added Tax (Amendment) Act, 2026 aligns tax policy with national monetary strategy. Large-scale gold mining companies that surrender 30 per cent of their total gold production directly to the Bank of Ghana are exempt from paying VAT on those specific quantities.
Additional enactments signed into law include the Tribunals Act, the Maritime and Related Offences Act (aligning domestic enforcement with international UNCLOS standards), and the National Defence University Act, 2026.
